First, I give and bequeath to my wife Elizabeth Smith all the Land now held by me in this county said to contain five hundred and forty acres be the same more or less for an during her natural life time. Secondly, I give and bequeath said tract of Land to my seven children namely James, Delila, Jacob, Philip, Willam, Rachel & Jonathan Smith to be divided among them at the death of my wife Share and Share alike. Thirdly, I leave my Brother in Law, John Williams the executor of this my last will and testament. Given under my hand and seal this 22nd day of May 1833. Signed and sealed by Alexander Smith *************************************************************************** Court Record of the proving of Alexander Smith's will At a Curcuit Superior Cout of Law and Chancery continded and held for the County of Hardy at the court house there of on the 24th day of September 1833. This last will and testament of Alexander Smith decd was presented in Court by John Williams the executor therein named, proved by the oath of Eliza Weaver on the subscribing witnesses thereto and ordered to be certified an on the motion of the said Executor a certificate is granted him for obtaining a probate thereof ? in due form he having together with Simon Switzer of William Babb his securities entered into and acknowledged a bond in the penalty of Two hundred dollars conditioned as the law directs and taken the oath of such Executor as prescribed by Law. And at a Curcuit Superior Court of the Law of Chancery continued & held for the County of Hardy on the 22nd day of September in the year 1835. This last will and testament of Alexander Smith decd which has been heretofore proved by one of the subscribing witnesses thereto was this further proved by the oath of John L. Smith another of the subscribing witness thereto and ordered to be recorded.
