Attest Eli Marsh, Clerk William Carder & wife to Elias Stutler Del’ to Grantee Dec 8th 1838 This Indenture, made this 17th day of September 1838 between William Carder and Martha his wife of the County of Harrison and State of Virginia of the one part and Elias Stutler of the County of Harrison and State of Virginia of the other part witnesseth that the said William Carder and Martha his wife for and in consideration of the sum of fifty dollars lawful money of Virginia to them in hand paid, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, enfeoffed, released and confirmed, and by these presents, do grant, bargain, sell, alien, enfeoff, release and confirm unto the said Elias Stutler his heirs and assigns forever, all one certain tract of Land with its appurtenances, lying and being in the County of Harrison, on the right hand fork of Kincheloe Creek and bounded as follows, to wit, Beginning at a hickory & Chesnut oak in one of the original lines, thence with the (?) slope of a ridge N 67 W 80 poles to an ash, N 31 W 44 poles to a hickory 61 W 80 poles to a stone pile (?) Pointers. West 14 poles to a Dogwood N85 W 34 poles to a chesnut oak, S 51 poles W 24 poles to a chesnut oak, west 20 poles to a white oak N 57 W 15 poles to black oak & ches + oak N 18 W 54 poles to a hickory on another of the original lines, thence along the same East 242 poles to the beginning, containing one hundred and seven acres more or less, being a part of a survey made for William Baston and number 8. To have and to hold the above described tract of land with the appurtenances, to the said Elias Stutler his heirs and assigns forever to and for the only proper use and behoof of the said Elias Stutler his heirs and assigns forever, and the said William Carder and Martha his wife for themselves their heirs we do hereby covenant to and with the said Elias Stutler his heirs and assigns forever, that they will forever warrant and defend the above described tract of land to the said Elias Stutler his heirs and assigns forever against all persons claim ing by through or under them but against no other person or claim whatsoever. In testimony whereof they have here= unto set their hands and seals this day and year first above written signed sealed and delivered Wm. Carder, Jr in the presence of Marthy Carder Harrison County Court Clerks office Sept 17th 1838 The forgoing Deed was acknowledged in Court by the said William & Martha ( she the said Martha being privately examined) and ordered to be recorded attest Eli Marsh C.H.C.C. I do hereby acknowledge that in describing the boun= daries of the within described tract of land that there was a mistake in describing the distance from the Hickory to the Black oak 2 Pointers the original corner - and that said distance from said Hickory to said Black oak 2 Pointers is 283 poles instead of 242 poles and should have read in the within Deed. As witness my hand & seal this 8th day of December 1838 Teste Wm Carder Jr B.
