Despard January 3 1844] Deed 44 acres Jerry Run This Indenture made this 1st day of January 1842 between John Goff (Trustee under a Deed of Trust executed by Abijah Warren on the 14th day of October 1841 to secure and provide for the payment of certain debts therein mentioned which is duly recorded in the Clerk's office of the County Court of Harrison Co. Va) of the County of Harrison and State of Virginia of the one part and Burton Despard and Eli Marsh of the County and State aforesaid of the other part witnesseth that the said John Goff Trustee as aforesaid for and in consideration of the sum of One hundred ninety six dollars lawful money of Virginia to him in hand paid the receipt whereof is hereby acknowledged hath granted bargained, sold, aliened enfeoffed released and confirmed and by these presents doth grant bargain sell alien enfeoff, release and confirm unto the said B. Despard & Eli Marsh their heirs & assigns forever all that certain tract or parcel of land with its appurtenances lying and being in the Coutny of Harrison & State of Virginia on erry run a branch of Simpsons Creek and bounded as follows, to wit, Beginning at a Black Walnut (an old corner) and running thence North 36º E 9 1/2 poles to a white oak, thence South 15º W 107 poles to a Sugar & Beech, thence West 121 poles to a white oak thence N 58º East 184 poles to the beginning containing forty four acres being the same land upon which Warre's Still House is erected & situated on the N. W. Turnpike road and the same land conveyed by Jonathan T. Curry to said A Warren. To have and to hold the above described tract of land with the appurtenances to the said B. despard & Eli Marsh their heirs and assigns forever to and for the only proper use and behoof of the said B Despard & Eli Marsh their heirs and assigns forever and the said John Goff Trustee as aforesaid for Himself his heirs &c do hereby covenant to and with the said B Despard and Eli Marsh their heirs and assigns forever that he will forever warrant and defend the above described tract of land to the said B Despard and Eli Marsh heirs and assigns forever against all persons and claims whatsoever claiming under said Abijah Warren.
