THIS RECORD WAS DONATED TO THE HARRISON COUNTY WVGenWeb PROJECT/ARCHIVES ONLY: ********************************************************************* Transcribed and donated by: Jane Hunter Hodgson 1997 HARRISON COUNTY VIRGINIA DEED BOOK 1798 James Nutter to Benjamin Holdin This Indenture made this nineteenth day of March ano domini one thousand seven hundred and ninety eight between James Nutter and Ann his wife of the County of Harrison and State of Virginia of the one part and Benjamin Holdin of Harrison County and the State aforesaid of the other part Witnesseth that the said James Nutter and Ann his wife for and in Consideration of the sum of one hundred pound to them in hand paid the receipt whareof is hereby acknowledged have granted bargained and sold aliened enfeoffed and Confirmed and by these presents do grant bargain and sell alien feoff and Confirm unto the said Benjamin Holdin his hairs and assigns forever a certain tract or parcel of Land lying and being in the County of Harrison and State aforesaid Situated on turkey run a branch of Elk Creek adjoining lands of the hairs of Hezekiah Davisson and Thomas Nutter Junior and bounded as follows Begining at a sycamore at the mouth of said run and Running thence By Davissons line South twenty six degrees East forty four poles to a Chesnut tree South thirty degrees West one hundred and twenty nine poles to a hickory thence by Thomas Nutters line North Sixty degrees West one hundred and twenty pole to a hickory North thirty degrees East one hundred and seventy poles to a Shugar tree on the bank of said Creek thence up the same South forty seven degrees East Eighty five poles to the beginning Containing one hundred and sixteen acres together with all ways waters water courses and Commodities thereunto belonging or in anywise appertaining and Reversion and Reversions Remainder and Remainders Rents Issues and profits of all and singular the above mentioned premises and every part and parcel thereof with their and every of their appurtenances unto the Benjamin Holdin his heirs and assigns to the only proper use Benefit and Behoof of him the said Benjamin Holdin and his hairs and assigns forever and the said James Nutter and Ann his wife for themselves their heirs Executors administrators do covenant promise and grant to and with the said Benjamin Holdin and his hairs and assigns that the they said James Nutter and his wife now at the sealing and Delivering of these presents is Ceized of a good shure perfect and indefeasable Estate of inheritance in fee simple of and in the premises hereby granted and that they have good power and lawfull authority to convey the same to the said Benjamin Holdin in manner aforesaid and the said James Nutter and Ann his wife their heirs and assigns do Covenant promis and Grant to and with the said Benjamin Holdin his hairs and assigns that he the said Benjamin Holdin his hairs and assigns shall and may from time to time and at all times ever hereafter peacibly and quietly have hold use occupy and enjoy all and singular the Right title Interest and Claim and Demand of the Said James Nutter and Ann his wife in and to the said tract of land and premises above mentioned with the appurtenances without any let trouble hindrance molestation interrruption or Denial whatsoever of the said James Nutter and Ann his wife their hairs and assigns and of and from all and every other person and persons lawfully claiming under them or any parson or parsons whatsoever laying any lawfull Claim thereto in witness whareof they have hereunto set their hands and fixted there Seals the Day and year first above Written James Nutter Seal Ann Nutter Seal Harrison County March Court 1798 This Indenture was acknowleged by James Nutter and Ann his wife (she being privily Examined and Consenting) to Benjamin Holden which is ordered to berecorded By the Court Teste Benj.
