Tyson to Abijah Warren 1839 Deed Book 27, Pages 336-337 This Indenture made this 13th day of July 1839 between John P. Tyson Commissioner appointed by the Circuit Superior Court of Law & Chancery of Harrison County in the case of Robert Milar's Executor against EB Jackson's heirs &c of the County of Harrison & State of Virginia of the one part and Abijah Warren of the County & State aforesaid of the other part witnesseth that the said Tyson Commissioner aforesaid pursuant to the several decrees in the above named cause sold to the said Waren the house and lot and land herein after named and has been directed by said Court to convey the same to the said Waren for and in consideration of the premises and of one dollar lawful money of Virginia to him in hand paid the receipt whereof is hereby acknowledged hath granted, bargained, sold, aliened enfeoffed, released and confirmed and by these presents doth grant, bargain, sell, alien, enfeoff, release and confirm unto the said Warren his his heirs and assigns forever all one certain tract or parcel of land with it's appurtenances lying and being in the County of Harrison on the waters of Elk Creek lying about 10 miles south East of Bridgeport - also one house and lot in the said town of Bridgeport known as the Romine House and lot for a more particular description reference is had to the Deed of trust executed by Isaac T. Tyson to EB Jackson and to the Deeds for the same to said Isaac T. Tyson. To have and to hold the above described land and House & Lot with the appurtenances to the said Abijah Waren his heirs and assigns forever to and for the only proper use and behoof of the said Abijah Waren his heirs and assigns forever. In testimony whereof the aforesaid John P. Tyson Commissioner as aforesaid hath hereunto set his hand and seal the day and year first above written Signed, sealed and delivered John P. Tyson (Seal) in the presence of Commissioner Harrison County to wit: We George Kayser and Joseph J. Winter Justices of the Peace in said County do hereby certify that John P. Tyson party to the within conveyance hath duly acknowledged the same before us in our County aforesaid on the 13th day of July in the year 1839 and desired us to certify the said acknowledgement to the Clerk of the County Court of Harrison County in order that the said conveyance may be recorded as witness our hands and seals this 13th day of July 1839 G Kayser (Seal) Joseph J. Tyson Deed This Indenture, made this 13 day of July 1839 between Abijah Waren and Sarah his wife of the County of Harrison and State of Virginia of the one part and John P. Tyson of the County and State aforesaid of the other part witnesseth that the said Abijah Waren and Sarah his wife for and in consideration of the sum of Two hundred dollars lawful money of Virginia, to him in hand paid, the receipt whereof is hereby acknowledged ha granted, bargained, sold, aliened, enfeofed, released quit claim and confirm unto the said John P. Tyson his heirs and assigns forever, all one certain tract or parcel of land with its appurtenances, lying and being int eh County of Harrison on the waters of Elk Creek lying about 10 miles South East of Bridgeport also one house and lot in the said Town of Bridgeport known as the Romine house and lot being the same land and house and lot purchased by the said Waren under a decree of the Circuit Court in the case of Robert Miller's Exr agst EB Jackson's heirs &c To have and to hold the above described land and house and lot with the appurtenances to the said John P. Tyson his heirs and assigns forever to and for the only proper use and behoof of the said John P. Tyson his heirs and assigns forever and the said Abijah Waren and wife for themselves their heirs &c do hereby covenant to and with the said John P. Tyson his heirs and assigns forever, that they will forever warrant and defend the above described land & house and lot to the said John P. Tyson his heirs and assigns forever against all persons and claims whatsoever, claiming under them but no further. In testimony whereof the aforesaid Abijah Waren and wife have hereunto set their hands and seals the day and year first above written. Signed sealed and delivered in the presence of A. Warren (Seal) Sarah Warren (Seal) Harrison County to wit: We George Kayser and Joseph J. Winter Justices of the peace in said County do hereby certify Abijah Waren party to the within conveyance hath duly acknowledged the same before us on the 13 day of July in the year of our Lord 1839 and desired us to certify the said acknowledgement to the Clerk of the County Court of Harrison County in order that the said Conveyance may be recorded as witness our hands and seals this 13th day of July 1839 G. Winter Justices of Peace in this County aforesaid in the State of Virginia do hereby certify that Sarah Waren wife of Abijah Waren parties to the within Deed for the purpose of conveyance of real estate to John P. Tyson bearing date the 13 day of July 1839 and hereunto annexed personally appeared before us in our County aforesaid being examined by us privately and apart from her husband and having he deed aforesaid fulley explaind to her she the said Sarah Waren acknowledged the same to be her act and deed and desired us to certify the same to the County Court of Harrison that the same may be recorded.
