Odell -------------------------- WILL. I, Susan J. Odell, widow, of Clarksburg, West Virginia, do make this my last will and testament, hereby revoking all former wills by me made, if any, and I direct- I. The payment of all my just debts and funeral expenses suitable to my condition in life. I give, devise and bequeath all of my estate, real, personal and mixed, wherever situate, to the persons hereinafter named, and I direct that my executor, hereinafter named, shall first sell any and all real estate which I may own at the time of my death, and that he distribute the proceeds thereof as personal pro- perty as hereinafter directed. II. I give and bequeath to my son, Oren H. Odell, of Kansas City, Missouri, one-third of all my said estate, and a like one-third to Milton L. Odell, of New Richmond, Ohio, and the remaining one-third I give and bequeath to my son, William E. Odell, and his daughter, Beulah Odell, and his son, Lovell Odell, equally, that is, to each of said last named three persons an equal part of the one-third of my said es- tate, and should one of them die prior to my death, the said one-third of my estate I give and bequeath to such of said last named three persons as shall survive me; and, likewise, should either of my sons, Milton L. or Oren H. die prior to my death, their said respective shares in that event I give and bequeath to their child or children which may be living at the time of my death. I hereby select and appoint my son, Oren H. Odell, executor of this my last will, with full power and authority vested in him to sell, lease and dispose of all my real estate and convert the same into cash, the same to be done by him, either at public or private sale as in his opinion may obtain the best results for the estate. And I further direct that he shall not be required to execute any bond as such executor. Witness my signature this the 31st day of January, 1910. Susan J. Odell’s name and the names of the three witnesses were typed on the original will.] 57 Oren H. Odell, of the County of Jackson and State of Missouri, this day presented to the Clerk of the County Court of Harrison County, West Virginia, a paper writ- ing purporting to be the last will and testament of Susan J. Odell, deceased, (who at the time of her death had a known place of residence in the county of Clermont and State of Ohio) and offered the same for probate. Thereupon came James J. Chidester and Harvey F. Smith, two of the subscribing witnesses thereto, and after being duly sworn depose and say that Susan J. Odell, the testatrix signed and acknowledged the said paper writing as and for her last will and testament in their presence, and at the time thereof the said Susan J. Odell was of sound mind and disposing memory and over 21 years of age; and at her request they both signed their names thereto in her presence and in the presence of each other as attesting witnesses thereof; the said will being thus proven, is admitted to probate and ordered to be recorded and filed as directed by law.
