Submitted by Mabry Benson, benson@acm.org, on Saturday August 31, 1996 LDS mf #530424 Kanawha County, (West) Virginia Will Book 2, p391ff James McCown will I James NcCown of the county of Kanawha [] of Virgonia, being old and feeble in body but being possessed of [] usual and memory good, considering my age, knowing the uncertainty of life and desising to make some disposition of my property and estate that I.am or may be hereafter possessed, both real and persona; and by these presents make, constitute , declare and confirm this to be my last will and testament, hereby revoking all my former wills and parts of wills do dispose of my estate in the manner and form as [] towit: Item the 1st. I desire that my administrator pay out of the proceeds of my personal estate all my just debts, funeral & burial expenses. Item 2nd. I give and bequeath in fee simple unto my two sons jointly and equally, , Walter L. McCown and James McCown all of the tract of land whereon I now reside, supposed to contain 177 acres, to be the same more or less. And also in addition to the land I give and bequeath with my two sons aforesaid, all the propertyy on my premises, stock of all kinds, plan- tation tools, household and kitchen furniture. But they are to pay out of said property or my estate all my just debts, funeral and burial ex- penses aforesaid. And also are to pay to each of my sons and daughters here named towit: George McCown, William McCown, Matthew McCown, Jane [?]antram, Caroline Tunney, and [?] Harrison, or to their heirs or personal representatives one hundred dollars each. Item 3rd. I give and bequeath unto my two daughters by my 2d wife now living [?] Wood and Eliza [?], jointly and equally and in fee simple or so far as I may have the right or power to dispose of, under the will of the late John Duddinging decd all the interest that I [?] ny marriage to my present wife Elizabeth E. McCown a daughter of said John Dudding decd in the estate of said Dudding decd and now retained as dower by the widow of said deceased, consisting of [?] and personal estate. Item 4d. I give and bequeath to each of my three sons and three daughters aforenamed, George McCown, William McCown, Matthew McCown, Jane Lanham, Caroline Tinsley, & Julia Harrison or their heirs, per- sonal representatives one hundred dollars to be paid to each of them by my two sons Walter D. McCown and James McCown as aforesaid under item the 2d and are to be considered joint payments of the one hundred dollars to each of said sons & daughters. Item 5th. As I have made advancements to my daughter Synthia Lovejoy in land & other property, heretofore, I consider that she has received the full amount of her interest and therefore I shall not make any further provision for her. Item 6t. [?] reservation of the right of dower for my beloved wife [?] McCown according to law, which I desire that she may [?] right out of the land & personal property assigned to my [?] Walter D. McCown and James McCown under the 2d clause [?] from the estate of said John Dudding decd under his will was named and bequeathes under item the 3d to my daughters Le- [?] Wood and Elvira Franklin. Signed, sealed, & delivered this 31st day of March in the year 1860 in the presence of [?] Agee, Wm J. High, John H Dudding James McCown Kanawha County Recorders Office 12th July 1871 {Walter McCown presented the will of James McCown. John Dudding swore that he witnessed it and acknowledged that this was that will. On jUly 20, 1871, Hezekiah Agee and William High appeared, and swore that this was the will of James McCown. The will being proved, it was admitted for probate and recorded.
