Transcribed by Laura Thomas, May 31, 1998 Know all by these presents that we - Asel R. Marshall and Margaret Jane Marshall, wife of said Asel R. Marshall, and Daniel Fay and Mary Ann, his wife, Alexander McCulley and Rachel McCulley, his wife, John D. Creighton and Elizabeth Jane Creighton, his wife, William Kidd and Nancy E., his wife, Sarah Marshall, James Marshall and Deborah R. Marshall being heirs at law of James Marshall, Deceased. in Consideration of the sum of Two Thousand Tree Hundred and Forty Dollars ($2340.00) in hand paid by George McCaslin of the County of Marshall, State of West Virginia, have Bargained and sold and do hereby grant and convey unto the said George McCaslin his heirs and assigns forever the following premises situated in the County of Marshall in the State of West Virginia, and Bounded and Described as follows to wit: Beginning at a Walnut and Running South Two Degrees East one hundred and sixty three poles and one tenth to a small Dogwood, thence West Eighty poles to a White Oak, thence North Two Degrees West one hundred and Sixteen poles to a white oak, thence North Thirty Two Degrees East Twenty six poles to a white oak, thence North Twenty Five Degrees East Twenty six poles to a Maple, thence North seven Degrees West Seventeen poles to a white oak, thence North Fifty Two Degrees one 3/4 poles, thence East 58 poles to the place of Beginning, and containing Seventy Seven Acres. It being the same tract of land conveyed by George Marshall to said James Marshall, Deceased. To Have and to Hold said premises with the appurtenances unto the said George McCaslin his heirs and assigns forever. And the said Asel R. Marshall and Margaret Jane Marshall, his wife, and Daniel Fay and Mary Ann Fay, his wife, Alexander McCulley and Rachel McCulley, his wife, John D. Creighton and Elizabeth Jane Creighton, his wife, William Kidd and Nancy E. Kidd, his wife, Sarah Marshall, James Marshall and Deborah R. Marshall for themselves and heirs doth hereby Covenant with the said George McCaslin his heirs and assigns that they are lawfully Seized of the premises aforesaid, that the premises are free and clear from all encumbrances Whatsoever and that they will forever Warrant and Defend the same with the appurtenances unto the said George McCaslin, his heirs and assigns, against the lawful claim of all persons Whomsoever. I further Certify that I did Examine the said Mary A. Fay and Margaret Jane Marshall, Separate and apart from their said husbands, and did then and there make known of them the Contents of the foregoing instrument, and upon that Examination they declared that they did voluntarily sign Seal & Acknowledge the same, and that they are still satisfied therewith. Marshall, whose names are signed to the Deed hereto annexed bearing date on the 29th day of March 1870 acknowledged the same before me in the County aforesaid. The State of West Virginia, County of Marshall, Township of Sand Hill, To wit: I, James Smith a Justice of the peace for the County of Marshall in the State of West Virginia, do certify that Elizabeth J. Creighton, and Nancy E. Kidd, the wife of John D. Creighton and wife of William Kidd whose names are signed to the Deed hereto annexed bearing date on the Twenty ninth day of March Eighteen hundred and seventy personally appeared before me in the County aforesaid and being Examined by me privily and apart from their husbands and having the Deed aforesaid fully Explained to them they the said Elizabeth J. Creighton, and Nancy E. Kidd, acknowledged the said Deed to be their acts an Declared that they had willingly Executed the same and do not wish to Retract it.
