WV State of West Virginia, County of McDowell, to wit: In the Criminal Court of said county: The Grand Jurors of the State of West Virginia, in and for the body of McDowell now attending said court, upon their oaths present that Dayton Mullins and Isom Muncy, on the (blank) day of September, 1938, about the hour of (blank) o'clock in the daytime of that day, feloniously and burglariously, did break and enter into the dwelling house of one G. P. Evans, situated in the said county of McDowell, with intent the goods and chattels of him, the said G. P. Evans, in said dwelling house then and there being, then and there feloniously and burglariously to steal, take and carry away; one Fad wrist watch, of the value of $10.00, one Smith & Wesson 38 Special pistol, of the value of $25.00 and one Ivory Johnson 38 Pearl handled pistol, of the value of $15.00, of the total value of $50.00, of the goods and chattels of said G. p> Evans in the said dwelling house, in the county aforesaid, then and there being found, then and there feloniously and burglariously did steal, take and carry away, against Found at the October Term of said Court, 1938, upon the testimony of Dr. G. P. Evans and E. M. Patrick duly sworn in open court to testify the truth and sent before the Grand Jury this the 3 day of October, 1938. Samuel A.
