McDowell County, West Virginia Deeds page 4, book unk Elizabeth Muncy, ET AL.To Deed Jane Hagerman This deed, made and entered into this the 5th date of April, 1938, by and between Elizabeth Muncy and Mose Muncy, her husband, George Goodman and Lilly B. Goodman, his wife, Lines Goodman and Elsie Goodman, his wife, Pearlie Goodman and C.E. Keen, her husband, Rozelia Goodman, single, and Mary Goodman, widow, the heirs at law of James Goodman, deceased, parties of the first part, and Jane Hagerman, party of the second part.Witnesseth:That for and of the sum on One hundred ($100.00) dollars, cash in hand paid by the said party of the second part to the said parties of the first part, the receipt of which is hereby acknowledged in full by each of the said parties of the first part, the said parties of the first part have this day bargained and sold and by these presents do hereby bargain, sell, grant and convey unto the said Jane Hagerman, the said party of the second part, with covenants of General Warranty of title, all their right and title to and interest in, in law and equity, as heirs of the said James Goodman, deceased, the surface and timber of a certain tract or parcel of land situate d on the Wimmer Fork of the Middle Fork of Bradshaw Creek, in the District of Sandy River, County of McDowell and State of West Virginia and being more particularly bounded and described as follows, to-wit: Beginning on a beech on the bank of the Wimmer Fork of the Middle Fork of Bradshaw Creek; thence running a straight line up the hill to a stake, near an oak in the line of Gus Wimmer; thence running with said Wimmer line to a stake in the line of W. M. Hagerman and Rogers Brothers to a stake on top of a knob; thence running with the line of the said W. M. Hagerman down the hill to a buckeye, near said Wimmer Fork; thence running a straight line up; the hill to a chestnut on top of Buckeye Ridge, thence running down a spur to a stake, near a large rock in Wimmer Fork; and thence running up said Wimmer Fork, with the meanders of the old creek bed, to the beginning corner on the beech; containing 45.7 acres, more or less, being all of a 10.7 acre tract and 35 acres, more or less, of a 70 acre tract; and being a part of a tract of land heretofore conveyed by Sam Killgore and Easter Killgore, his wife, to James Goodman and Jane Hagerman, by deed bearing date the 28th day of March, 1917, and duly of record in the office of the Clerk of the County Court of McDowell County , West Virginia in Deed Book No.74, page 47, and reference is hereby made to said deed for a further description and identification of the property hereby conveyed. The said parties of the first part hereby covenant, that they have the right to sell and convey the above described interests in the above described real property, that the said party of the second part shall have quiet and peaceable possession of same free from all encumbrances, and that they will execute such further assurances of title as may be required. To have and to hold the above described interests in the above described real estate, together with all improvements and appurtenances ;thereunto belonging or in anywise appertaining, unto the said Jane Hagerman, the said party of the second part, her heirs and assignees forever.
