Witnesseth that for and in consideration of the sum of twenty four dollars them the said Alem & Elizabeth Hager in hand paid by the said Russel Hager & Rhoda Fletcher as well as the natural love and affection which they bear toward them have given granted bargained and sold and by these present doth give grant bargain sell an confirm unto the said Russel Hager an His heirs forever a certain tract or boundary of land containing by estimation 150 acres be the same more or less lying an being in the County of Mercer and State of Virginia on the waters of Brush Creek and bounded as follows Beginning on the top of stony ridge at the head of a hollow opposite the lower end of said Russel Hagers field and down said hollow north west to a Buck eye & cucumber on the side of the point west of the said hollow thence crossing the Creek near same course to the top of the Middle Ridge to a Hickory & white oak thence west along the top of said ridge to two white oaks thence nearly South by a marked line crossing the creek to the top of the stony ridge thence along the top of the stony ridge nearly east to the Beginning. They the said Alem & Elizabeth Hager also for and in part of the above consideration doth give sell bargain alien and confirm and by these presents unto the said Rhoda Fletcher and the heirs of her body a certain tract or boundary of land containing by estimation 150 acres be the same more or less lying and being in the County of Mercer and State of Virginia on the waters of Brush Creek and bounded as follows Beginning on two white oaks on the top of the middle ridge corner to Russel Hagers land thence nearly west along the top of said ridge to Davidsons line thence nearly south with Davidsons line to Higinbothams line thence with his line to the top of the Stony ridge thence with Archibald Baileys line east along the top of the Stony Ridge to Russel Hagers corner thence with his line nearly north to the top of the Middle Ridge to the beginning. The said Alem & Elizabeth Hager doth covenant and agree that the said Russel Hager and Rhoda Fletcher and their heirs as aforesaid to have and hold the said tracts or boundaries of land forever free from the claim of them the said Alem & Elizabeth Hager and their heirs and of all persons claiming by or through them to the sole use an behoof of them the said Russel Hager and Rhoda Fletcher and their heirs as aforesaid together with all the appurtenances thereunto belonging with this understanding an agreement that the said Russel Hager and Rhoda Fletcher nor their heirs as aforesaid shall sell or convey either of said tracts or boundaries of land during the natural life of the said Elizabeth Hager. In Testimony whereof we have hereunto set our hands and affixed our seals the day and year first above written. Thorn the undersigned Justices of the peace in and for said county Alem Hager party to a Deed bearing date on the 10th day of September 1849 an hereto annexed and acknowledged the same to be his act an deed and desired us to certify said Given under our hands and seals this 4th ay of March 1850. James M Compton JP J C Thorn JP We Elijah Peters and Theodore Smith Justices of the (sic) for Mercer County do hereby certify that Elizabeth Hager party to a certain Deed bearing date on 10th Sept 1849 an hereunto annexed personally appeared before us in our County aforesaid and acknowledged it to be her act and deed and wish not to retract and desired us to certify the said acknowledgement to the Clerk of the Court so it can be recorded.
