Will of Augustus W. Cole, Sr., 1888 - Mercer Co. WV I, Augustus W. Cole,Sr. of Mercer County, Princeton, West Virginia being of sound mind, but feeble in body do make this my last will and testament hereby revoking all former wills by me. First, I desire that my body be decently buried. Second, I will direct that all my just debts be paid, and to this end direct that the proceeds of my personal property except that here unafter bequeath to my wife shall be applied to the payments of my debts, and enough of my land shall be sold to complete such payment. The said of my land shall be in the following order. First, the tract of one hundred and seventy three acres known as Evans Land. Second, A tract of one hundred acres being in the Valley of East River Mountain land upon which A.J. Cole now resides. Third, a tract of one hundred and fourty acres upon which A.W. Cole, Jr. now resides And fourth, the Mill property should the above land fail to pay my debts, then I desire that my Executor shall designate the order of which my remaining land shall be sold. Third, I will and bequeath to my beloved wife Margaret all my household and kitchen furniture, and other personal property to be cherished by her to the value of two hundred dollars, Fourth, I devise to my said wife one third of all realestate of which I am possessed on hand. I am entitled quality and value considered to be assigned and laid off so as to enclude the dwelling house to be held and enjoyed by said wife during her natural life, and at her death to pass and decend to the persons named in the next succeeding clause. The devise to my said wife is intended to be in lien of her dower in my said lands. Fith, after enough of my said land shall have been sold to discharge my indebtness, I devise all the remaining land to my children and Grandchildren as follows: To my Son A.W. Cole Jr. one share. To my Son Allen T. Cole one share. To my Daughter Harriet Louise Thornton, wife of Jas.A.Thorton one share. To my Son John H. Cole now deceased by Martha (Comer) Cole his wife one share. And to the children of Andrew J. Cole and Mary Cole one share. I also devise the land which shall be assigned to my wife as provided in the fourth clause to my children Allen T Cole, Augustus W. Harriet L. and my Grandchildren to wit the children of John H. and Andrew J. Cole to be held by them in intrest similar to the last above devise in this clause. Said last named land to go to my said desires at the death of my wife. I hereby nominate, and appoint C.R.McNutt as executor of this my last will and testament given under my hand this the 17th day of February, 1888 A.W.Cole,Sr. Witness: A.J. Thompson R.B. McNutt C.R. This day the last will and testment of Augustus Washington Cole, Sr. was presented in said office and proven by the oaths of R.B. McNutt, and C.R. McNutt, to of the subscribing witnessess thereto and is ordered to be recorded, and C.R. McNutt the executor named in said will appear and take the oath prescribed by law together with R.B.McNutt as his security intrest into, and acknowledged a bond in the penalty of one thousand dollars with condition as prescribed by law, which bond being approved is ordered to be recorded. Certificate is granted to the said C.R.McNutt for obtaining probate of said will in due form, and upon the motion of said Executor is ordered that Wm.G. Hatcher, S. Hearn, A.J. Thompson be appointed appraiser of said estate of Augustus Washington Cole,Sr. deceased who first being duly sworn shall appraise said estate and return an inventory thereof to this office.
