These electronic pages cannot be reproduced in any format for profit or other presentation. ============================================================ Alexander Eddy’s Will In the name of God I Alexander Eddy of Batell district Monongalia County state of West Virginia being of sound mind and memory Do make this my last Will and Testament in manner and form following to wit; I direct my executors immediately after my decease to pay all of my funeral charges and just debts out of the first moneys that comes in their hands. 2nd I will and bequeath to my daughter Malinda in addition to what goods and chattels that she claims in my houses all the household and kitchen furniture that she sees proper to select for her own use; one horse beast and two Mitch cows out of what stock I may have at my decease, such ewes as she sees proper to Choose and Select, and further I will to her Two hundred Dollars as her full share of my estate. 3rd I will and give in addition to what I have heretofore given to my grand daughter Sarah Ellen Eddy Five dollars as her full portion and share of my estate. 4th I Will and give to my Grandson Alexander Eddy Twenty-five Dollars to be paid to him when he arrives at the age of fourteen years that I desire he shall purchase for himself a suit of clothing. 5th I will and give to my three sons Simon, Elihu & Elias J. Eddy all of the Residue of my estate to be equally divided between them share and share alike and lastly I direct my executor to settle up my Estate as soon as the circumstances of my estate shall admit and to pay my devises as here above described. And further I appoint my sons Elihu and Elias J. Eddy as my executors of this my last will and testament revoking all other wills heretofore made by me. In witness wheof [sic] I Alexander Eddy the testator have to this my last will and testament set my hand and seal the 5th day of October 1878. Alexander his x mark Eddy The above and forgoing will was signed sealed and delivered in the presence of us at the request of the testator who have this day witnessed and subscribed to in the presence of Each other this 5th day of October 1878 R. S. Lantz W. B. Minor West Virginia ss: At a county court of Monongalia County court timed and held in for and said county at the Court House thereof on November 8th 1882: -- This day came Elias J. Eddy & Elihu Eddy, Executors named in a paper writing, purporting to be the last will and testament of Alexander Eddy deceased, and filed their petition in writing for the probate of said will in these words; To the county court &c. and alleging that the same is in the custody of R. S. Lantz: whereupon the court doth direct process to issue against the partied ordained in said petition as interested in the probate of said will, as well as against the party in whose custody said will is; and it being suggested that the parties so interested therein are ready and willing to accept service of said process at once and desire that the said paper writing shall at once be probated as and for the last will and testament of said Alexander Eddy deceased; wherefore, the court doth order said process to issue returnable before it forthwith. And it also appearing by said petition, that Alexander Eddy the grand child of said Alexander Eddy deceased, so interested in t! he probate of said will, is an infant under the age of 21 years, It is further ordered that W. W. Houston be appointed his guardian ad litern to attend to said infants interests in the premises And thereupon same [sic; came] the said R. L. Lantz, and produced the said paper writing so in his custody as aforesaid; and thereupon the said petitioners Elias J. Eddy & Elihu Eddy offered said will for probate before the court as and for the last will and testament of the said Alexander Eddy deceased in accordance with the petition aforesaid; and it appearing to the court that all the persons named in said petition as being interested in the probate of said will are willing and desirous that the same shall be now probated as and for the last will and testament of said Alexander Eddy deceased and they hereby waiving the issuing of or service of any process on said petition on them respectively as shewn by writing filed with said petition marked “A”; Thereupon and in the presence of sa! id guardian ad litern of said infant Alexander Eddy, named in said petition, said will was duly proven by the oaths of R. S. Lantz & William B. Minor subscribing witnesses thereto, and ordered to probate, and was then and there duly probated as and for the last will and testament of said Alexander Eddy deceased; and thereupon came the said Elias J. Eddy & Elihu Eddy so named and appointed in said will as executors thereof, and then and there duly qualified as such executors by taking the oath prescribed by law, and by giving bond as such in the penal sum of Eight Thousand dollars conditioned according to law, with Alpheus W. Brown & John E. Price securities therein, who justified on oath as to their sufficiency which bond was duly approved by the court. A copy, Teste, W. T.
