Witnesseth that for and in consideration of the sum of one dollar to them in hand paid at or before the sealing and delivering of these presents the receipt whereof they do hereby acknowledge, have bargained and sold and by these presents, do bargain and sell unto the said Toleson Shoemate and his heirs and assigns a certain tract of land containing one hundred and twenty four acres being part of a survey of 300 acres by survey bearing date 29th day of June 1785 and granted to the said Daniel Shoemate the 17th day of October 1787, lying on New River at the mouth of Rich Creek and is bounded as followeth to wit. Beginning at double black oak and red oak on the end of ridge below the mouth of said creek near New River in Monroe County and running with the other lines North 37 degrees, West 88 poles to a black oak and hickory, North 57 degrees, West 60 poles to two black oaks, North 53 degrees East 172 poles to a sugar tree and ash corner to William and white oak and South 38 degrees, East 24 poles to two white oaks on said line on a hillside and leaving said line through the survey, South 5 degrees, West 30 poles crossing and down said creek to a hickory on the bank and down the meanders of the same, South 20 degrees, West 78 poles to a bitter elm by the creek and South 67 degrees, West 21 poles to three sycamores at the mouth of the creek on the bank of New River and North 5 degrees, West 45 poles to the Beginning. To have and to hold the said land with all and singular, the appurtenances thereunto belonging to the said Toleson Shoemate to the sole use and behoof of the said Toleson Shoemate and his heirs and assigns forever and the said Daniel Shoemate and Milly his wife for themselves and their heirs doth covenant with the said Toleson Shoemate and his heirs and assigns the said tract of land from themselves and their heirs and assigns to the said Toleson Shoemate and his heirs and assigns will warrant and forever defend against all claims or claimers claiming or that may claim the said land. In witness whereof they have hereunto set their hands and seals this day and year aforesaid, signed, sealed and delivered in presence of Daniel Shoemate {SEAL} Milly Shoemate (SEAL} Monroe County to wit, we, Conrad Peters and Jacob Peck, magistrates in and for the County of Monroe and State of Virginia, do hereby certify that Daniel Sumate Sr and Milly his wife personally came before us this day and acknowledged the with in conveyance of one hundred and twenty four acres of land from themselves to Toleson Shumate to be their act and deed, the said Milly being first privately examined separate and apart from her said husband, relinquiseth her right of dower and declared that she had willingly signed and delivered the same and the partys aforesaid desired us to certify this their acknowledgement to the Clerk of the County Court of Monroe in order that this conveyance from them to the said Toleson Shumate may be recorded.
