The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ************************************************************************ Deed Book 1799-1805, Page 56-57 This Indenture made the seventeenth day of June, in the year of our Lord one thousand eight hundred between James Elison of the one Part; and Samuel Peck of the other Part, both of the State of Virginia, witnesseth that the said James Ellison, for and in consideration of the sum of three hundred pounds lawful money of Virginia, to him in hand paid, by him the said Samuel Pack, the receipt whereof, he doth hereby acknowledge, have bargained, sold, aliened, enffessed and confirmed, and by these Presents, do grant, bargain, sell, allien, enffess and confirm, to the said Samuel Pack, and his heirs forever, a certain tract, or parcel of land, lying and being in Monroe County, and State of Virginia, containing 223 acres by survey bearing date the thirty first day of May one thousand seven hundred eighty five, lying on New River, opposite and above the mouth of Bluestone-- and bounded as followeth to wit, Beginning at a mulberrey and hickory, on the River bank, North 50 degrees, East 10 poles to a suggar tree, South 48 degrees, East 85 poles to a buckeye, South 73 degrees, East 106 poles to a walnutt, South 60 degrees, East 94 poles to a red oak and ash, 30 degrees, East 180 poles to a white oak and Spanish oak, South 200 poles to an elm, South 30 degrees, East 108 poles to a red oak, white oak and ash on the River bank, thence 703 poles, down the meanders of the River, to the Beginning, with all its appurtenances thereunto belonging, or in anywise appertaining, to have and to hold, the said tract or parcel of land, with its appurtainces, to the said Samuel Peck and his heirs forever, to the only proper use and behoof of him the said Samuel Peck and his heirs forever, and the said James Ellison, at the time of sealing and delivering of this Indenture, is seized of sure and indefeasible estate of inheritance, in fee simple of, and in the tract or parcel of land hereby conveyed, and every part thereof, and that the same is, now and forever, that it shall remain, free and clear from all incumberances, or charges of what nature or kind soever made, done or sufficed by him or claiming by or under him and the said James Ellison will forever warrant and defend tract or parcel of land hereby conveyed to the said Samuel Peck and his heirs or assigns against the claim or demand of any person or persons whatsoever. In witness whereof James Ellison hath hereunto set his hand and seal the day and year above written. Signed, sealed and delivered in presence of John Hutchison. At a court held for Monroe County at the house of James Alexander, Gent. on Tuesday the seventeenth day, one thousand eight hundred. This Deed of Bargain and Sale from James Ellison to same was acknowledged in Court, she the said Elisabeth, wife to the said James, was first personally examined as the law directs, and ordered to be recorded.
