The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ************************************************************************ Deed Book 1799-1805, Page 39-40 This Indenture made the sixth day of April, in the year of our Lord one thousand seven hundred and ninety nine between Francis Farley of the County of Greenbrier and State of Virginia of the one part, and Samuel Pack of the of the County and State aforesaid of the other part, witnesseth that the said Francis Farley, in order to secure the payment of a debt of one hundred and two pounds with interest and costs due from him the said Francis, unto Messrs. Skiles and Arbuckle, for which he is sued, in the worshipful Court of Greenbrier, and the said Samuel Pack, has entered his special bail, to abide the condemnations of the said Court, and in consideration of one dollar, to him in hand paid by the said Pack, at or before the ensealing and delivery of these presents, the reciept whereof is hereby acknowledged, he the said Francis Farley, hath granted, bargained and sold, and by their presents, doth grant, bargain, and sell unto the said Samuel Pack, all that tract, or parcel of land lying and being in the County of Greenbrier, on a New River, containing eighty acres, by grant bearing date the fifteenth day of October one thousand seven hundred and eighty six, being the land the said Farley now lives on, with the blacksmith shed and tools, also one other tract containing two hundred and twenty acres, by grant bearing date the twelth day of August one thousand seven hundred and ninety two, lying and being in the County of Greenbrier on the Bufaloe Run, a Branch of New River, also one other tract containing ten acres, by grant bearing date the thirtieth day of May one thousand seven hundred and eighty five, lying and being in the County of Montgomery, in an Island of New River below Culbertson's Bottom and the recession and reversions, remainder and remainders, yearly of other rents, tithes and profits to thereof, I also all the estate, right, tittle, interest, trust, property, claim and demand, whatsoever both at law and in equity of him, the said Francis Farley, unto or out of the said lands, tenements, hereditaments and premises. To have and to hold, the said bargained premises herein before mentioned to be hereby granted with their and every of their appurtainances unto the said Samuel Peck, his heirs, executors, administrators and assigns forever, upon trust, nevertheless, that the said Samuel Pack shall as soon as he conveniently can, in case he suffers by said bail (after having advertised, the time and place of the sale of the property, before mentioned, in some publick newspapers, published nearest the residence of the said Francis Farley) proceed to sell the same to the highest bidder for the best price that can be obtained, and out of the monies arising from the sale, in the first place to pay and satisie, all reasonable charges, attending such sale and then the above mentioned debt and the residue of the monies arise in from such sale as aforesaid (if any) to the use of the said Francis Farley, his executors, administrators, or assigns, to such person or persons as he by written under his hand shall a ppoint and in default of such appointment, to such person and persons as would be thereto entitled by virtue of the statute, for distribution of intestates estates, and it is also fully to be understood by and between the said Francis Farley and Samuel Peck by the above indenture in trust, that if the said Francis Farley shall or doth satisfie and pay the aforesaid debt or so to provide that the said Samuel Peck shall be exonorated from the payment thereof an exculpated from the before mentioned bail, it shall and is to be compleat and full release, for the said estate so deeded in trust-In Witness whereof the said Francis Farley hath hereunto set his hand and affixed his seal the day and year first above written. his Francis (X) {SEAL} mark Signed, sealed and acknowledged in the presence of John Hutchison, Matt Farley and Lewis Adkins. At a court held for Monroe County at the house of James Alexander, Esq. the 17th day of September 1799-this Deed of Trust from Francis Farley to Samuel Peck proved by John Hutchison and Lewis Adkins, ordered to be certified.
