Witnesseth that the said John Nealy and Deliah his wife for the consideration of three dollars to them in hand paid by the said James Swiney the receipt whereof is hereby acknowledged, have bargained and sold and by these presents do bargain and sell, confirm unto the said James Swiney his heirs and assigns three tracts or parcels of land adjoining other in the County of Monroe and State aforesaid, lying and being on the Buflow Branch or branches, a branch of New River, the first a servey of one hundred and twenty fore acres made for Francis Farley and pattend in his name by patent baring date the tenth day of March one thousand seven hundred and eighty fore and bounded as follows to wit. Beginning at a white oak and hickory, corner to James Swiney, North 30 degrees, East 166 poles to a white oak and two pines, corner to the same and, leaving the same, South 50 degrees, East 102 poles to a white oak, South 104 poles to a pine and white oak, South 50 degrees, East 34 poles to a buckey, South 45 degrees, West 20 poles to fore poplars in the head (Note: I cut off the bottom line of the document when I photocopied it) in his name patent baring date the 25th day of August one thousand seven hundred and ninety two begins as follows, to wit. Beginning at two ash suckers on a line of eight acres survey on date for Francis Farley and with lines South 81 degrees, East 40 poles crossing Buflow Run to two pines thence crossing the eighty acre survey North 15 degrees, East 50 poles crossing a branch of said lines to a white oak and up the said branch North 77 degrees, East 30 poles to a sugar and hickory tree, South 67 degrees, East 50 poles to a white oak and hickory, North 30 degrees, East 166 poles to two pines and a white oak, corner to the same thence through the survey North 67 degrees, West 67 poles to two white oaks and ridge by a path, South 80 degrees, West 26 poles to a white oak, North 66 degrees, West 38 poles to a black oak and dogwood on the patent line on the oppisite line of the survey with said line South 24 degrees, West 89 poles to a white oak and dogwood, corner to the same by a deep branch, South 26 degrees, West 144 poles to the Beginning, the two within mentioned tracts or parcels of land was the same that was deeded from Drury Farley and wife to me, John Neely. The third parcel of land is a part of the two hundred and twenty acres that is above mentioned that was made to Francis Farley the part now sold and deeded is the same that was deeded to me by William Pack and wife which is supposed to be about 33 1/3 acres it being the one equal third part of the undivided ballance of the survey that was not deeded to me by Drury Farley and wife. To have and to hold, the said tracts or parcels of land, with each and every of its appurtenances to the sole use and behoof of the said James Swiney and his heirs and assigns forever and the said John Neely and Deliah his wife for themselves and their heirs doth covenant with the said James Swiney and his heirs the said tracts or parcels of land from themselves and their heirs to the said James Swiney and his heirs or assigns against all person or persons whatsoever will forever warrant and defend. In witness whereof we have hereunto set our hands and seals the day and date above written. John Neely {SEAL} Deliah (X) Neely {SEAL} her mark Monroe County to wit, We, William McDaniel and John Pack, Justices of the Peace in the said County in the State of Virginia, do hereby certify that John Neely and Delilah Neely the wife of the said John Neely, parties to the within deed for the conveyances of real estate, personally appeared before us in our said County and acknowledged the same to be their act of deed, she being privately examined seperate and apart from her said husband, delcared she had willingly signed the same and that she wished not to retract it and wished us to certify the same to the Clerk of our said County of Monroe in order that the same may be recorded.
