I James Swinney of the county of Monroe and state of Virginia being weak in body but of sound mind, memory and understanding, do make this my last will and testament in manner and form following, to wit: First of all I recommend my sole to God who gave it, and my body to be buried in a decent manner. Second I desire that all my just debts should be paid out of my estate and my desire is that my wife shall hold the land wheron I now live and on other small tract of about ten or twelve acres on an island of New River opposite the house where I now live her time of life and also all the remainder of my estate holy of what kind soever it may be, except what is hereafter mentioned, I give to my son Vincen Swinney the two above mentioned tracts of land for him to have at the death of my wife and I also give to my several children as follows: To Mary one dollar, to Ann my second daughter one dollar and to Rachel one dollar and to Deliah one dollar and to Elizabeth one dollar and to Sieana one dollar and Delana one dollar and to William one dollar and to James one dollar and to Martin one dollar and to Vincen one dollar. And my further desire is that at the death of my wife whatever of my estate may be left not made use of by her, the land only excepted that I have given to my son Vincen, is to be equally divided amongst all my children and I appoint James Swinney and Vincent Swinney to be executors in this my will and I do hereby revoke all will or wills heretofore by me made and declare this to be my last will and testament as I have hereunto set my hand and seal this 26th Day of April 1825. his James X Swinney mark Test: Matt Farley Esther Farley Joseph Farley John Woodram James Gore Lewis Hutchison At Monroe, September Court, 1836 The last will and testament of James Swinney, dec'd, was presented in court and proven by oaths of John Woodram and James Gore, subscribing witnesses thereto and the same is ordered to be recorded and on the motion of Vincent Swinney, one of the executors therein named who made oath as such and together with Delaney Swinney, John Woodrum and William Adair, his securities, entered into and acknowledged bond in the penalty of $1,000.00 ----- conditioned as the law directs certificate for obtaining probate thereof in due form is granted him.
