C. Farinsworth (Farnsworth) From Will Book 2, p. 485, Pocahontas County, WV I Isaac M. C. Farinsworth being weak of body but sound in mind and feeling that I must soon resign my body to the tomb and my spirit to God who gave it make this my last will and Testament in manner and form following. That is to say First I desire that my body be decantly intered Secondly I give and bequeath to my beloved Mother Sarah Farinsworth my mare, Thirdly. I bequeath to my brother William C. J. Farinsworth all my land for which he is to pay one hundred and fifty dollars in the manner following. First he is to retain the amount due him from me in his own hands and the balance pay over to my executor or administrator which is to go to the paying of my other debts. Fourthly. I desire that all my dues be collected and applied to the paying of my debts. Fiftly. I desire that all my other personal property be valued and sold and the money arising therefrom be applied to the paying of my just debts untill they are all paid and the residue thereof be equally divided among by Brothers and sister in the following manner. My Brother Alexander R. L. Farinsworth to have one fifth my Brother William C. J. Farinsworth one fifth my Brother Phylander S. Farinsworth one fifth my Sister Mary Jane Farinsworth one fifth and my sister Martha A. Smith?s little son Isaac Farinsworth Smith one fifth. And lastly I do hereby constitute and appoint my Brother Alexander R. L. Farinsworth executor of this my last will and testament hereby revoking all former wills and testament by me made. July Term 1857 This writing purporting to be the last will testament of Isaac McFarinsworth decd was this day produced in court & proved by the oath of John Waugh one of the subscribing witnesses thereto & continued for further proof. On motion of the Executor named in said will a commission was directed to prove to ____ Gay a justice of the peace for this county requiring him to take the deposition of James Auldridge, a subscribing witness to this will who from sickness is prevented from attending court. Keen Clk Pocahontas County Court August Term 1857 Writing purported to be the last will & testament of Isaac McFarinsworth was again produced for probate and the deposition of James Auldridge one of the subscribing witnesses to the will taken by virtue of a commission opened by the clerk of this Court in obediance to an order of this court made at the July term 1857 being seen & inspected the execution of said will being proven to the satisfaction of the court this same is ordered to be recorded.
