Will of John B. Moomaw, 1894 - Raleigh Co. WV "The last Will and Testament of John B. Moomaw, of Raleigh County and State of West Virginia. "I, John B. Moomaw considering the uncertainty of this mortal life and being of sound mind and memory, do make and publish this my last Will and Testament, in manner and form following, (that is to say) First, I give and bequeath unto my two beloved daughters, Mary A. and Louisa E., all of the tract of land on which I now reside consisting of one hundred fifty four and ¾ acres more or less. (Nevertheless the said Mary A. and Louisa are to furnish my beloved wife, Ellender a decent maintenance during her natural lifetime.) I devise that my two daughters, Mary A. and Louisa E. are to have all my personal property of all kinds, money and Bonds, at the death of their beloved mother. I give and bequeath to my beloved son Phillip D. no more than he has already received. I give and bequeath to my beloved son Benjamin, no more than he has already received. I give and bequeath to my beloved daughter Harriet C. no more than she has already received. I give and bequeath to my beloved daughter Sarah F. no more than she has already received. I give and bequeath to the heirs of my beloved daughter Ellen B. dec. no more than she had already received during her lifetime. And lastly as to all the rest, residue and remainder of my personal estate, goods and chattels of what kind and nature soever, I give and bequeath the same to my beloved wife Ellender and two daughters, Mary A. and Louisa E. And to my beloved son Caswell C. I give and bequeath to him no more than he has already received. And I hereby appoint my son Caswell C. Moomaw Executor of this my last Will and Testament, hereby revoking all former wills by me made. In witness whereof, I have hereunto set my hand and seal this 18 day of January in the year of our Lord One Thousand Eight Hundred and Ninety Four. John B. Moomaw, the Testator, in the presence of each of us and was at the same time declared by him to be his last Will and Testament, and we, at his request, sign our names hereto as attesting witnesses. J. D. Meador residing in the county of Raleigh C. W. Moye residing in the county of Raleigh "In vacation of the County Court of Raleigh County West Virginia. In the Clerk's Office of said Court June 11th 1894. This day the last Will and Testament of J. B. Moomaw deceased was proved by the oaths of J. D. Meador and C. W. Moye witnesses thereto, and is ordered to be recorded, and on the motion of Caswell C. Moomaw, the Executor therein named, who made oath thereto, and together with John Beckley his security entered into and acknowledged his hand in the penalty of one hundred and fifty dollars, conditioned according to law, certificate is granted here for obtaining a probate of said Will in due form.
