Will of Vincent Phillips, 1878 - Raleigh Co. WV Know all men by these presents that I Vincent Phillips of the County of Raleigh and State of West Virginia, Farmer, being in ill health but of sound mind and memory do make and publish this my last Will and testament hereby revoking all former wills by me at any time heretofore made. And as to my worldly estate, and all property, Real Personal or mixed, of which I shall die seized and possessed or to which I shall be entitled at the time of my decease, I devise bequeath and dispose thereof in the manner following to wit: First: My will is that all my debts and funeral expenses shall by me [sic] Executor herein named be paid out of my estate as soon after my decease as shall by him be found convenient. Item I give and bequeath to the heirs of my oldest daughter Huldah the sum of one dollar to be equally divided between the several heirs. Item I give and bequeath to my oldest son John A. Phillips the sum of one dollar. Item I give and bequeath to my second son Joseph F. Phillips the sum of one dollar. Item I give and bequeath to my third son Reuben S. Phillips the sum of one dollar. Item I give and bequeath to my fourth son Clarkson P. Phillips the sum of one dollar. Item I give and bequeath to my firte [sic] son Rufus Phillips the sum of one dollar. Item I give and bequeath to my sixth son Lewis Phillips the sum of one dollar. Item I give and bequeath to my seventh son, Nehemiah Phillips the sum of one dollar. Item I give and bequeath to the heirs of Alfred and Hetta Lusk the sum of one dollar. Item I give and bequeath to my 3rd daughter, Sarah A., the wife of Joseph F. Meadows the sum of one dollar. Item I give and bequeath to my daughter Mary the wife of Isaac R. Lily the sum of one dollar. Item I give and bequeath to my present wife Delpha all of my personal property that may be left at my death. Item I desire that all of the property that came by my last wife be retained by her, either real or personall [sic] or mixed. And lastly I do nominate and appoint my friend Robert Scott to be the Executor of this my last will and testament. In testimony whereof, I, the said Vincent Phillips have to this my last Will and testament contained on one sheet of paper subscribed my name and to this I have subscribed my name and offered my seal this the 9 day of March One thousand eight hundred and seventy eight. His Vincent Phillips (seal) Mark Signed, sealed published and declared by the said Vincent Phillips as and for his last Will and testament in the presence of us who at his request and in his presence of each other have subscribed our names as witnesses thereto. Robert Scott (seal) James D. Meador (seal) State of West Virginia Raleigh County to wit I, George Bailey Clerk of the County Court in and for said County and State do certify that James D. Meador one of the subscribing witnesses to the foregoing will of Vincent Phillips this day personally appeared before me and made oath that he was present, and witnessed the signature of Vincent Phillips to the above Will, the [sic] he Vincent Phillips acknowledged the same as his own last Will and Testament, and that he witnessed said Will with his own hand and signature at the same time in the presence of the testator and in the presence of the other subscribing witness Robert Scott. Given under my hand on this 26th day of October 1891. George Bailey, Clerk State of West Virginia Raleigh County to wit I, George Bailey Clerk of the County Court in and for said County and State do certify that Robert Scott one of the subscribing witnesses to the foregoing will of Vincent Phillips this day personally appeared before me and made oath that he was present, and witnessed the signature of Vincent Phillips to the above Will, that he Vincent Phillips acknowledged the same as his own last Will and Testament, and that he witnessed said Will with his own hand and signature at the same time and in the presence of the testator and in the presence of the other subscribing witness James D.
