     In the name of God Amen. I Peter Simmons of the State of West Virginia and County of
Ritchie being of sound mind and memory do hereby make publish and declare this to be my last
Will and Testament hereby revoking and making void all former Wills by me at any time heretofore
made.

     FIRST : I desire my body to __ decently and respecably intered.

     SECOND: I give and bequeath unto my wife Sarah Simmons all my property both real and personal
until her death.

     THIRD: I desire my executor after the decease of my wife Sarah Simmons should she outlive
me to sell at public sale to the highest bidder all my real estate. One third to be paid Cash in
hand the residue in one and two years: The purchaser giving his notes with good security bearing
interest from date.

     FOURTH: I give and bequeath to my son Aaron Simmons my wagon and farming utensils in addition
to what he has received.

     FIFTH: I give and bequeath to my daughter Phebe Jones and her heirs one fifth of the value
of my real estate less eighty dollars ($80.00) to be taken from the first payment.

     SIXTH: I give and bequeath to my daughter Mahala Crummett and her heirs one fifth of the value
of my real estate less ($20.00) to be taken from the first payment.

     SEVENTH: I give and bequeath to my daughter Sidney Jordan and her heirs one fifth of the value
of my estate.

     EIGHTH: I give and bequeath to my daughter Mary Zickefoose and her heirs one fifth of the value
of my real estate.

     NINTH: I give and bequeath to my daughter Sarah Susan Simmons or her heirs one fifth of the value
of my real estate and also all my house-hold and kitchen furniture and beds and bedding all personal
property on the farm such as horses cows and sheep after the decease of me and my wife for services
done and doing by her Sarah Susan Simmons after she becomes of age or over 21 years old.

TENTH: I hereby nominate and appoint S.P. Crummett as my Executor. In Witness whereof I hereunto
subscribe my name this 21st day of January 1882 A.D.

The above and foregoing instrument was at the date thereof signed sealed published anddeclared by the
said Peter Simmons as and for his last Will and Testament in presence of us who at his request and in
his presence and in the presence of each other have subscribed our names as Witnesses.

State of West Virginia County Court of Ritchie County April Term 1884 (April 14 1884) "A writing
purported to be the last Will and Testament of Peter Simmons deceased was this day produced in open
court and James Moyers and Charles Moyers the subscribing witnesses to said Will appeared in open
court and being duly Sworn testified that they were present and saw the said Peter Simmons sign his
name to said Will by mark and they in his presence and at his request and in the presence of each
other signed their names as Witnesses thereto. Whereupon said Will is duly proven and ordered to be
recorded A copy from the minutes of said Court.
