DEED, 1808 Tyler Co. WV 143 Acres, Middle Island Creek Benjamin Murray to Lewis Ripley Ohio County, West Virginia Deed Book 6, page 297 This Indenture made this sixth day of January in the year of our lord one thousand eight hundred and eight between Benjamin Murray and Dorcus his wife in the county of Brooke and state of virginia of the one part and Lewis Riplit of the county of ohio and in the State aforesaid witnesseth that the said Benjamin and Dorcus for and in consideration of the sum of two hundred dollars to them in hand paid the receipt whereof they do hereby acknowledge Have granted, bargained sold enfeofed released and confirmed and by these presents do grant bargain sell enfeoff release and confirm to the said Lewis Riplit his heirs and assigns all that tract or parcel of Land with the apurtances situate lying and being in the aforesaid county of Ohio on the waters of middle island creek and is bounded as follows beginning at a white oak corner to Benjamin Bond and with his line south two Degrees West 205 poles to a red oak thence west one hundred and ninety six poles to a White oak thence N9 degrees East 177 poles to a white oak in a line of the original 500 acres tract thence N78 degrees E 176 poles to the beginning containing two hundred acres it is part of the same tract of land which the commonwealth of virginia granted a patent to John Rolfe now decsd. and by said Rolfe conveyed to Benjamin Murray the present grantee as by the respective deeds of conveyance reference thereto being had will more fully appear - To have and to hold the above described two hundred acres of Land with the apurtanances to the said Lewis Riplit and his heirs and assigns forever. And the said Benjamin Murray and Dorcas his wife for themselves their heirs assigns do hereby convenant to and with the said Lewis Riplit and his heirs and assigns that they the said Benjamin & Dorcas the above described tract or parcel of land with the apurtanances to the said Lewis Riplit his heirs and assigns Shall and will warrant and forever defend against all persons and claims whatsoever. Witnesseth that the said James Caldwell and Frances his wife for and in consideration of the sum of two hundred and eighty six dollars to them in hand paid by the said Lewis Ripley the receipt whereof is hereby acknowledged, hath granted bargained and sold and by these presents doth hereby grant bargain and sell unto the said Lewis Ripley his heirs and assigns forever a certain tract or parcel of land situated in the said County of Tyler and on Middle Island Creek on the north side of the creek adjoining the lands of Benjamin Sayre & others and bounded as followeth to wit Beginning at a beech in Benjn Sayres line, thence with the same S30 W160 poles to a small sugar tree on the creek bank thence down the creek with the several meanders thereof and binding thereon 92 poles to a hickory in Sayres line and with the same S30 W40 poles to a white oak corner to said Sayre and with his line at N84 E20 poles to a beech on the creek bank, thence down the creek with the several courses thereof and binding thereon 284 poles to a sugar tree, below Nutters fork, thence up said Fork, S40 E21 poles to a sugar tree N80 E36 poles to a poplar N50 E26 poles to a white oak N68 E36 poles to a white oak N30 E22 poles to a sugar tree East 27 poles to an ash N24 E40 poles to a beech thence crossing said fork S61 E44 poles to the Beginning containing one hundred and forty three acres To Have and to Hold the aforesaid tract of land situated bounded as aforesaid unto the said Lewis Ripley his heirs and assigns forever. And the said James Caldwell and Frances his wife for themselves their heirs Executors and Administrators doth hereby covenant and agree to and with the said Lewis Ripley his heirs and assigns that they the said James Caldwell and Frances his wife the aforesaid tract of land unto him the said Lewis Ripley his heirs and assigns they will warrant and forever defend from all and every person or persons laying any kind of legal claim to the same. Creek This Indenture made this 27 day of August in the year of our Lord 1829 between David McClure of the county of Brooke and state of Virginia by Isaac Smith of the County of Tyler and State of Virginia of the one part and Lewis Ripley of the said County of Tyler and State of Virginia of the other part Witnesseth that by an article of agreement dated the 3rd day of May 1826 between the said David and Isaac the said David did sell unto the said Isaac a tract of land on Middle Island Creek adjoining the said Ripley and others in the said County of Tyler and in and by the said article the intention of the said Isaac to sell a part of said land supposed to be about seventy acres to the said Lewis is stated at the rate of two dollars an acre and the said David to oblige and accommodate all parties as to convey the same to the said Ripley with the consent of the said Isaac when the said Ripley should in fact pay him the said David for the said land at the rate aforesaid and whereas the land so sold by the said Smith to the said Ripley by survey is found to contain sixty five acres and whereas the said Ripley heretofore to wit about the 6 of May last did pay unto the said David fifty dollars on account of the said land and the said Ripley has this day given to the said David his note for the sum of eighty dollars payable the 1 of April next with legal interest from this date until payment that being the balance of the purchase money of the said land and the said Isaac being desirous that a deed for the said land should now be made to the said Ripley as an evidence of his said approbation and consent has become a party to this deed. Now therefore this Indenture witnesseth that the said David McClure and Isaac Smith as well in consideration of the (?) as of the sum of one dollar in hand paid them by the said Lewis Ripley hath granted bargained and sold and by these presents doth hereby grant bargain and sell unto the said Lewis Ripley his heirs and assigns forever part of the said tract of land sold by the said David to the said Isaac as aforesaid situated on Middle Island creek Tyler county aforesaid and adjoining the lands of the said Lewis Ripley and others, which said tract of land intended to be conveyed by this deed is supposed to contain sixty five acres and is bounded as followeth to wit Beginning at a white oak one of the corners of the original survey thence S11W50 poles to a white oak S643/4E92 poles to a black oak N85E54 poles to pointers at the road N12E85 poles to 3 dogwoods on the original line and with the same West 146 poles to the place of beginning estimated to contain sixty five acres be the same more or less To have and to hold the aforesaid tract of land situated and bounded as aforesaid unto the said Lewis Ripley his heirs and assigns forever And the said David McClure and Isaac Smith for themselves and their heirs doth hereby covenant and agree to and with the said Lewis Ripley his heirs and assigns that they the tract of land aforesaid hereby conveyed unto the said Lewis Ripley his heirs and assigns they will warrant and forever defend from all and every person or persons whatever it being understood that the said land in equity shall be subject and liable to the said David for the payment of the said note given this day by the said Ripley to him the balance of the purchase money of the said land. Witnesseth that the said parties of the first part, for and in consideration of the sum of One Dollars to them in hand paid by the said party of the second part, the receipt whereof is hereby confessed and acknowledged, have granted, bargained, sold, remised, released, aliened and confirmed, and by these presents do grant, bargain, sell, remise, release, alien and confirm unto the said party of the second part, and to his heirs and assigns forever, all that certain tract or parcel of Land, lying & being in the said County of Tyler situate on waters of Middle Island Creek Beginning at a white oak, thence S 11º, W 50 poles to a white oak, thence S 643/4º E 52 poles to a Dogwood, thence N 22º E 74 poles to a Stone, thence N 13º E 60 poles to a Stone, thence N 65º E 76 poles to a Stone, thence N 18º W 120 poles to a Sugartree, thence N 85º W 67 poles to a Maple & Ironwood, thence S 12º W 75 poles to a stone, thence S 9º W 138 poles to the Beginning Containing one hundred & forty one acres by survey be the same more or less, being the land whereon the said Daniel Ripley now lives, together with all and singular, the hereditaments and appurtenances thereunto belonging or in anywise appertaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof; and all the water right, title, interest, claim and demand whatsoever of the said parties of the first part, either in Law or Equity of, in and to the above bargained premises with the said hereditaments and appurtenances: To have and to hold, the said premises above described to the said party of the second part, his heirs and assigns to the sole and only proper use, benefit, and behoof of the said party of the second part, his heirs and assigns forever. And the said parties of the first part, for themselves their heirs executors and administrators, do covenant, grant, bargain, and agree to and with this said party of the second part, his heirs and assigns, that, at the time of the ensealing and delivery of these presents, they are well seized of the premises above conveyed, as of a good, sure, perfect, absolute and indefeasible estate of inheritance in the law in fee simple, and that the above bargained premises in the quiet, and peaceable possession of the said party of the second part, his heirs & assigns against all and every person or persons lawfully claiming or to claim the whole or any part therefore, they will forever Warrant and Defend.
