WV Submitted by Muriel Schulz (schulz@usc.edu) Tyler County Will Book 3, Page 233 I, Daniel Ripley, of the County of Tyler and State of West Virginia, being of sound mind & disposing memory make my Last Will and Testament in manner and form, following, that is to say: First, I will and direct that sufficient of my personal property be sold by my Executors hereinafter named as soon as convenient after my decease, for the payment of all my just debts and funeral expenses, and that the residue of my personal property remain on the farm on which I now live for the support of my wife Elizabeth Ripley, she to use and enjoy the same as she may see proper, and at her death the same, or so much thereof as may remain shall become the absolute property of my son Thomas Ripley. Second, To my son William Ripley I give and bequeath the following real estate, that is to say: Town Lot Number Seven as laid down & numbered in the plan of the Town of Centreville in Tyler County, West Virginia together with all the buildings thereon erected and all the appurtenances thereunto appertaining, also a certain parcel of ground composed of Lots number 1 & 2 and a fraction of a lot in the said Town of Centreville, situated on the West side of Main Street, and at the lower end of said Town, on which said parcel of ground there is a tannery erected, which is now in the possession of my said son William Ripley, which said parcel of ground with all the buildings & appurtenances as well as Lot No. 7 ion said Town, I give to my said son William his heirs and assigns forever. Third, My son Lewis Ripley having already received from me in advance what I consider his fair proportion of my estate, I therefore make no further provisions for him, in this, my will. Fourth, To my son Thomas Ripley, I give and bequeath my home farm on which I now reside, to him and his heirs forever, but with the following reservation, saving, and restriction, that is to say that my wife Elizabeth Ripley is to remain on said farm, in the house with my said son Thomas, during her natural life, he my said son Thomas to support her in a decent and comfortable manner to procure for her in sickness competent medical advice & assistance, nurses or help, and at her death to have burried in a decent and Christian like manner and also that my said wife Elizabeth shall have and receive for her own use & benefit during life one third of the yearly proceeds of my said home farm. Fifth, To My daughters (viz) Louisa Jane Henry, the wife of David Henry; Mary Crumrine, the wife of John Crumrine; and Nancy James, the wife of George James, I give and bequeath the sum of Four Hundred Dollars, each and for the payment of the foregoing bequests to my said daughters, I will and direct that my two sons William & Thomas Ripley, if they see proper so to do may take a tract of two hundred acres of land which I own on Fosters run a branch of Sancho Creek in Tyler County, adjoining the lands of John G. Ash, George Mason & Others, and pay to my said three daughters each, the aforesaid sum of $400, within six years in yearly payments of sixty six dollars, and sixty six & two third cents, to each of my said daughters until they are severally paid the aforesaid sum of $400, the first of said yearly payments to become due & payable in one year from the time of my death, And if any one of said payments should not [be] paid when due, the same shall bear legal interest from the time when due, until paid; and the forcing bequests of $400, to each of my said daughters shall be a lien on the aforesaid tract of 217 acres of land until the same are fully paid, provided the said tract of land be taken by sons William & Thomas under the provisions of this article of my Will. And in the event my said two sons decline or refuse to take the aforesaid tract of 200 acres of land and pay to my said daughters the bequests of $400 each as provided in this Fifth article of this Will, then in that event the said tract of two hundred acres of land shall become the joint property of my said three daughters, they to hold the same in equal proportions in fee simple. Sixth and lastly, I hereby constitute and appoint my two sons William Ripley & Thomas Ripley, Executors of this my Last Will & Testament hereby revoking any and all former wills or testaments by me heretofore made, And I hereby direct that my son Executors be permitted to qualify without giving bond, or if a bond be given that no security be required of them. Engle Codicil to the Will of Daniel Ripley, which will is dated the 25th day of May, 1874, I Daniel Ripley having disposed of the tract of 200 acres of land mentioned in the fifth section of my said Will by deed dated the 26th day of August, 1880, to William Ripley, the said fifth section of my said Will is therefore hereby revoked, my said will in all other respects to remain the same. Engle Christian Engle Clerks office of the County Court of Tyler County West Virginia September 10th, 1884 The foregoing Last Will with a codicil thereto annexed of Daniel Ripley, deceased, late of Tyler County was this day presented in the clerks office aforesaid for probate and thereupon the execution of the said Will and codicil by the said Daniel Ripley was fully proved by the oaths of B. Engle, C. Engle, and Christian Engle subscribing witnesses to the same whereupon the said Will and codicil was admitted to record as and for the last Will and codicil thereto annexed of the said Daniel Ripley, deceased.
