Va., 27 Aug. 1865; 15 May 1866. Son JOHN, dau. MARY JANE [FARNSWORTH], grandchildren LAFAYETTE L. LORENTZ, ALEXANDER M. LORENTZ, PERRY L. LORENTZ, MARIETTA LORENTZ, and SARAH R. LORENTZ. Son John Ireland and [son-in-law] D. D. T. Farnsworth, exs. Testator bequeaths to grandchildren LAFAYETTE L., ALEXANDER M., PERRY L., MARIETTA, and SARAH R. LORENTZ, $1,000 each from personalty, if personalty not sufficient for pmt. of bequests then testator's son John and dau, Mary Jane to complete pmt. equally provided suit between testator and John Walden which was pending at time will was made is settled in favor of testator; if Walden wins sd. suit the afsd. legatees are to lose from legacy equal shares of costs and expenses connected with sd. suit, together with equal share of value of land so lost "and payment shall be withheld from them"; afsd. legacies to be pd. when sd. heirs reach age of 21; also to same grandchildren proceeds of sale of lots and houses in Buckhannon to be applied as pmt. of sd. legacies; to testator's son JOHN IRELAND, 232 a. of land "from the upper end of the tract of land of home place including the David Jackson tract a part of which is in dispute in suit with John Walden"; if sd. suit is lost by testator, other heirs to provide for preceding bequest; also to sd. JOHN IRELAND, prior gift of $350; to dau. MARY JANE [FARNSWORTH] and heirs, $860, a prior gift from testator to D. D. T. Farnsworth [husband of sd. Mary Jane], also to sd. MARY JANE sufficient land valued at $25 per acre to make her share equal to that of John Ireland; to son JOHN and dau.
