David V Uhl & Others To Joseph Pugh & Others This indenture made this 14th day of October 1828 between David V UHL and Sally his wife, Elias Keller and Rachel, his wife, George ARNOLD, Levi ARNOLD,Wm BROWN and Mary his wife, and Letty NEWBANKS of the first part and Joseph PUGH and Margaret his wife, Wm HENRY and Rachel HENRY of the second part. Whereas Daniel HENRY in his life time in the year 1803 entered 300 acres of land in the county of Wood on the waters of Big Run, but before the said Henry ____ (?) had said entry surveyed or patented he departed this life on January 1805 leaving the said Rachel Henry, Wm Henry, and Margaret PUGH, formerly Margaret HENRY his heirs at law, and whereas Richard ARNOLD made an entry on the 6th of December 1811 for 400 acres of land covering 125 acres of land entered for said HENRY as aforesaid had same surveyed on 20 March 1813 and had same patened and whereas the said Richard ARNOLD on the __ day of September 1823 by deed conveyed of said tract to Wm NEWBANKS. And whereas the said Richard ARNOLD departed this life on the __ day of September 1823 leaving John ARNOLD, LEVI ARNOLD, Elias KELLER and Rachel his wife, late Rachel ARNOLD,David V UHL and Sarah his wife, late Sarah ARNOLD, Lot ARNOLD, Richard ARNOLD,and Hannah ARNOLD his heirs at law. And whereas the said Wm NEWBANKS departed this life on the 3rd of July 1823 leaving Letty NEWBANKS his widow and Wm BROWN and Mary his wife, late Mary NEWBANKS, Harriet, James, Levi, Melinda,Abner, and Sarah NEWBANKS his children and heirs at law. And whereas the said parties of the second part heirs of the said Daniel Henry deceased. Since the death of the said HENRY have proceeded to have the aforesaid 125 acres of said entry surveyed and on the 28 of August 1827 obtained a patent for the same ---, And whereas the parties of the second part have instituted a suit in the Superior Court of Chancery for the Clarksburg District against the heirs of the said Richard ARNOLD, the widow and heirs of the siad Wm NEWBANKS the object of which suit is to assert(?)their older equity and obtain a repeal(?) of the patent obtained by the said Richard ARNOLD. So far as the same interfers(?) with the said 125 acres. And whereas the said parties of the first part are desirous of relinquishing their interest in the said 125 acres of land to the parties of the second part and not handt(?) a suit . Now in consideration of the premises as for further consideration of the sum of one dollar to the said parties of the first part by the parties of the second part in hand paid the receipt whereof they the parties of the first part hereby acknowledge, they the parties of the first part have remised released and forever quit claimed and by their presents(?) do remise release and forever quit claimed to the parties of the second part and all their right and title to all that part of the aforesaid tract of land granted by the Commonwealth of Virginia to Richard ARNOLD in his lifetime as lies as thence the following bounds to wit. Beginning at a Black Oak 9(comes or corner ?)to the ___(?)of Benjamin HENRY whence S45E22 poles to a Dogwood and two White Oaks on a line of land of Henry Johnson S42N240 poles to a Black Oak come to a survey of 200 acres in the name of H. MORRISON, whence N57W157 poles to a stake in the line(?) of the said heirs. Hence with their lines N43E124 poles to a stake N45W128 poles to a stake on BLAKES line thence with said line N43E5 poles to a Hickory corner to the line of Daniel HENRY thence with their line S45E128 poles to a White Oak and Hickory and whenceN45E104 to the beginning. It being the same land granted by the Commonwealth of Virginia to the parties of the second part on the 28th of August 1827. TO HAVE AND TO HOLD the aforesaid tract piece or parcel of land hereby released or intended to be released to the said parties of the second part and to their heirs forever free from the claim of the parties of the first part and all and every person or persons claiming by through or under them.
