In the name of God I CARR BAILEY of the county of Lewis in Virginia being of advanced age and feeble health but of sound mind due make ordain and publish this my last will and testament, first commending my soul to Almighty God the Father of all Mercy and the giver of every Good gift. 1. I will and devise to my wife the situation where I now live and to have a home there as long as she lives single and also she is to have her maintainance off one the farm whare I now live. 2. I will and devise to my son MANDAVILL BAILEY the upper part of my land where he is a liveing at this time to him and his heirs forever. 3. I will and devise to my son CARR BAILEY the lower part of my land which he lives on at this time and in his possession at this time the corner is to be at lower part of the place which is the north line thence running South as the road runs up to the fence which stands as a line fence between the two boys at this time thence running with s'd fence South East to the top of the ridge to him and his heirs forever. My son MANDEVILLE B BAILEY is to pay each heir fifty dollars except one heir and that one my son CARR BAILEY is to pay after my death my personal property is to be sold. At the highest bidder and the money collected it is to be divided eaqual amongst my children who has no share in my real estate. I have a small granddaughter a liveing with me by the name of SARAH JANE FISHER if she dos live with granFather and her granMother as long as as they both live she is to have her granMother's estate this my last will and testament. In testimony whereoff of I have there unto signed my name this 17th day of August 1861. CARR BAILEY Signed and published as the last will and testament {last two words crossed out} of CARR BAILEY in presence of SOLOMON WHITE and GEORGE W DEAN. Whereas I CARR BAILEY of the County and state aforesaid haveing made and only {? not sure of this word} exicuted my last will and testament in writing bearing date the 17th day of August 1861 Now I do hereby declare this present writing to be as a codicil to my said will and decreed the same to be annexed thereto and taken as part thereof and I do hereby give and bequeath to my grandson ALBERT W BAILEY as follows. I have put a mare to a horse this season for the express purpose of raising him a coult and if the mair fails to bring forth a colt he is to have a horse when he is twenty one years old. I witness whereof I the said CARR BAILEY have to this codicil set my hand and seal this 24th day of August 1861. CARR BAILEY Signed and published as the Last will and testament of CARR BAILEY in presence of SOLOMON WHITE and GEORGE W DEAN At a court continued and held for the county of Lewis at the court house thereof on Tuesday Oct 16, 1861 The last will and testament of CARR BAILEY deseased was this day presented in open court and together with the codicil thereto annexed severally proven by the oaths of SOLOMON WHITE and GEORGE W DEAN subscribing witnesses thereto who tesified that they subscribed their names as witnesses thereto in the presence of and at the request of and at the request of {repeated words were crossed out} the testator as also in the presence of each other and therefore the said will was admitted to probate. GEORGE A JACKSON clerk proterm --------------------- Inventory Book 4, pages 37-39 contain the appraisement and bill of sale for the estate of CARR BAILEY, deceased. Inventory Book 4, pages 118-119 contains the settlement for the estate of CARR BAILEY, deceased. Dated December 1, 1863 and lists WM J and JAMES R BAILEY as the administrators. The balance of the estate was $623.88
